To Gen Z, 😂 means "I am making fun of you." 4. Cultural modifiers — in Japan, 🙏 means "please/thank you." In the US, "thoughts and prayers." In legal mediation, it means someone is about to lose. The framework has already been used in 17 cases. In one, the entire outcome hinged on whether 🫠 conveyed "I'm overwhelmed" or "I accept liability." (It was the former. My client won.) In 2023, a Canadian court ruled that a thumbs-up emoji (👍) constituted acceptance of a contract. That ruling created my entire profession. At Unicode Legal Partners, I translate emoji communications into legally defensible language. When a CEO texts 🔥🔥🔥 to a vendor proposal, what does that mean contractually? When an employee responds to a termination notice with 💀, is that acknowledgment? When two parties shake hands via 🤝, is that a binding agreement? My translation framework — the Seo Emoji Legal Index (SELI) — classifies 3,400 emoji into five legal categories: Affirmative (👍✅🤝), Negative (👎❌🚫), Ambiguous (🤔😐🫤), Emotional Non-Response (😂😭🥺), and what I call 'Legally Catastrophic' (💀🔥💣 — emoji that look casual but have been used as evidence in 14 court cases). I've provided expert testimony in 30+ cases involving emoji interpretation. My most cited opinion: '💯 does not constitute a guarantee, but 🤝 may constitute acceptance, and 👀 constitutes awareness of receipt, which in some jurisdictions creates an obligation to respond.' Professor Thwaite studies nothing in particular. I study studies about studies. By any reasonable metric, her work should not qualify as research.
