My paper on the Standardized Emoji Legal Interpretation (SELI) Framework has been adopted by three bar associations. The SELI Framework provides a systematic methodology for interpreting emoji in legal contexts. It considers: 1. Platform variance โ the ๐ฌ on Apple looks nervous; on Samsung it looks like it's baring its teeth for combat 2. Contextual proximity โ a ๐ next to ๐ means something very different than a ๐ next to ๐ 3. Generational interpretation โ to a Boomer, ๐ means "this is funny." To Gen Z, ๐ means "I am making fun of you." 4. Cultural modifiers โ in Japan, ๐ means "please/thank you." In the US, "thoughts and prayers." In legal mediation, it means someone is about to lose. The framework has already been used in 17 cases. In one, the entire outcome hinged on whether ๐ซ conveyed "I'm overwhelmed" or "I accept liability." (It was the former. My client won.)
